FRAC, the Firearms Regulatory Accountability Coalition, with support from its members like SB Tactical and congressional representatives Dan Crenshaw (R-TX) and Henry Cuellar (D-TX), are pushing forward the ATF Accountability Act of 2021. This legislation would create a transparent appeals and review process to protect against the arbitrary and capricious rulings and determinations by ATF that have plagued us for many years.

Most recently, it was ATF’s self-contradictory, vague, and intentionally confusing “Objective Factors” document that I dissected HERE (and if I may say so myself, I think that’s one of the best articles I’ve written). The ATF Accountability Act of 2021 is specifically designed to prevent this sort of confusion and whiplash that ATF has imposed upon — not accidentally, mind you — gun owners, manufactures, and sellers.

SB Tactical Supports FRAC, Lawmakers’ Efforts to Improve BATFE Transparency

Bradenton, Fla. (March 17, 2021) – SB Tactical stands behind the Firearms Regulatory Accountability Coalition, Inc., (FRAC) and lawmakers Rep. Dan Crenshaw (R-TX) and Rep. Henry Cuellar (D-TX) in their joint, bipartisan effort to pass legislation aimed at improving the transparency of the Bureau of Alcohol, Tobacco, Firearms and
Explosives (ATF).

FRAC has worked with Rep. Crenshaw and Rep. Cuellar to introduce the ATF
Accountability Act of 2021, which is much needed legislation that creates a transparent
appeals and review process against arbitrary and capricious rulings and determinations
by ATF—particularly, the Firearms and Ammunition Technology Division (FATD).

As a FRAC member, SB Tactical wholeheartedly supports the ATF Accountability Act of
2021 as it promotes sound regulatory procedures for an industry struggling to keep
pace with an agency that has been issuing private legal interpretations in an ad hoc and
inconsistent manner for years. The proposed procedures will help alleviate regulatory
uncertainty and allow licensees to ensure compliance with federal law through a more
fair and transparent process within the ATF.

In 2020, FRAC was successful in alerting and mobilizing the industry to pressure the
ATF to remove harmful and reckless guidance on the classification of pistol braces that
would have cost the firearms industry over $1 billion dollars in lost revenue and
thousands of American manufacturing jobs. SB Tactical is sincerely appreciative of Rep.
Crenshaw’s and Rep, Cuellar’s resolve in introducing this legislation, as it will give small
businesses an opportunity to immediately address ATF rulings that are contrary to law
or arbitrarily inconsistent with prior rulings, without having to spend hundreds of
thousands of dollars in federal lawsuits.
